Terms of Service

Effective date: 24 March 2026

These Terms of Service (“Terms”) govern your use of the FileSafety content security API and related services (the “Service”) operated by Techlyft Pty Ltd (“we”, “us”, “our”). By accessing or using the Service, you agree to be bound by these Terms.

If you are using the Service on behalf of an organisation, you represent that you have authority to bind that organisation to these Terms.

FileSafety provide content security API that detects malware and identifies unsafe content in uploaded files. The Service is available through:

  • Dashboard: filesafety.dev/dashboard
  • Documentation: docs.filesafety.dev

To use the Service, you must create an account by providing a valid email address and password. You are responsible for:

  • Keeping your account credentials and API keys secure
  • All activity that occurs under your account
  • Notifying us immediately at support@filesafety.dev if you suspect unauthorised access

We reserve the right to suspend or terminate accounts that violate these Terms.

Your use of the API is subject to the rate limits and quotas associated with your plan tier. Current plan details are available at docs.filesafety.dev/billing/plans-and-pricing.

You must not:

  • Exceed your plan’s rate limits through automated retry loops or other means
  • Share API keys with third parties
  • Use API keys from multiple accounts to circumvent quotas

You agree not to use the Service to:

  • Upload, scan, or process content that is illegal under applicable law
  • Distribute malware, viruses, or other harmful software
  • Attempt to reverse-engineer, decompile, or disassemble any part of the Service
  • Interfere with or disrupt the Service’s infrastructure
  • Probe, scan, or test the vulnerability of the Service without written permission
  • Use the Service for competitive analysis or to build a competing product
  • Impersonate any person or entity
  • Use the Service in any manner that could damage, disable, or overburden it

We reserve the right to suspend or terminate access for violations of this section, with or without notice.

  • Files are uploaded to the Service solely for the purpose of scanning
  • We do not claim any ownership of or rights to your files
  • Uploaded files are automatically deleted immediately after scanning completes. A 24-hour lifecycle policy acts as a failsafe.
  • Scan metadata (file hash, file size, scan results) is retained for 30 days
  • We do not access, view, or use the content of your files for any purpose other than performing the requested scan

The Service offers multiple plan tiers (Free, Starter, Growth, Pro) with different scan quotas and pricing. Current plan details are published at docs.filesafety.dev/billing/plans-and-pricing.

  • All paid plans are billed monthly via Stripe
  • Payments are due at the start of each billing cycle
  • Prices are in USD and exclusive of applicable taxes

If you exceed your plan’s included scan quota, additional scans are billed at $0.01 per scan on your next invoice.

  • Upgrades take effect immediately. You will be charged a prorated amount for the remainder of the current billing period.
  • Downgrades take effect at the end of the current billing period. You retain access to your current plan’s features until then.

You may cancel your subscription at any time from your account settings. Cancellation takes effect at the end of the current billing period. We do not provide refunds for partial billing periods.

We use commercially reasonable efforts to maintain the Service’s availability. However, we do not guarantee 100% uptime. The Service may be temporarily unavailable due to:

  • Scheduled maintenance (we will provide reasonable advance notice)
  • Infrastructure incidents beyond our reasonable control
  • Emergency security patches

We are not liable for any loss or damage resulting from Service unavailability.

The scanning service is provided on a best-effort basis. While we strive to detect threats accurately, we do not guarantee that the Service will identify all viruses, malware, or NSFW content. You should not rely on the Service as your sole security measure.

To the maximum extent permitted by law:

  • The Service is provided “as is” and “as available” without warranties of any kind, express or implied
  • We are not liable for any indirect, incidental, special, consequential, or punitive damages
  • Our total liability to you for any claims arising from or related to the Service is limited to the amount you paid us in the 12 months preceding the claim
  • We are not liable for any loss or damage resulting from your reliance on scan results

Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including liability for fraud or personal injury caused by negligence.

  • Our Service: We own all rights to the Service, its software, documentation, and branding. These Terms do not grant you any rights to our intellectual property except the limited right to use the Service as described here.
  • Your Data: You retain all rights to your files and data. We claim no ownership of content you upload to the Service.

You may close your account at any time from your account settings at filesafety.dev or by contacting support@filesafety.dev.

We may suspend or terminate your access if you:

  • Violate these Terms
  • Fail to pay outstanding charges
  • Use the Service in a way that poses a security risk

Where possible, we will provide reasonable notice before termination.

Upon termination, a 30-day grace period begins during which you may reactivate your account by contacting support@filesafety.dev. After the grace period:

  • Your access to the Service is permanently revoked
  • Active API keys are deactivated
  • Your data is permanently deleted in accordance with our Privacy Policy retention schedule
  • Uploaded files (if any remain) are deleted immediately
  • Scan metadata is deleted after the 30-day retention period

Any outstanding payment obligations survive termination.

These Terms are governed by the laws of the State of New South Wales, Australia, without regard to conflict of law principles.

If a dispute arises from these Terms or your use of the Service:

  1. Negotiation — the parties will first attempt to resolve the dispute through good-faith negotiation by contacting support@filesafety.dev
  2. Mediation — if the dispute is not resolved within 30 days, either party may refer it to mediation
  3. Courts — if mediation fails, the courts of New South Wales, Australia have exclusive jurisdiction

We may update these Terms from time to time. If we make material changes, we will notify you by email at least 30 days before the changes take effect. Your continued use of the Service after the changes take effect constitutes acceptance of the updated Terms.

If you do not agree with the changes, you may close your account before they take effect.

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect. The unenforceable provision will be modified to the minimum extent necessary to make it enforceable while preserving its intent.

These Terms, together with our Privacy Policy and Data Processing Agreement, constitute the entire agreement between you and Techlyft Pty Ltd regarding the Service.
